Terms of Service

Review the terms that apply when you use Photo to Video, purchase credits, upload content, and generate AI media.

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and Joseph Works Limited (“we,” “us,” or “our”). They govern your use of the Photo to Video website at photo2video.ai and its browser-based application (collectively, the “Web Service”). They do not replace terms presented separately in the Photo to Video mobile app.

By accessing or using the Web Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Web Service.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding agreement where you live to use the Web Service.

The Web Service may create an anonymous account associated with your browser session. You are responsible for maintaining access to your account or session and for activity performed through it. Clearing browser data, changing devices, or losing access to an anonymous session may prevent recovery of its history or credits.

3. The Web Service

Photo to Video lets you submit images, videos, audio, text prompts, reference media, and generation settings to create or edit AI media. Available models, features, processing times, resolutions, output formats, and credit costs may change.

We may reject a request, limit a feature, or remove content when reasonably necessary to comply with law, provider rules, safety requirements, or these Terms.

4. Credits, prices, and payment

The Web Service sells one-time, non-renewing consumable credit packages for eligible generation and editing requests. The number of credits charged depends on the model, duration, resolution, audio setting, and other options displayed before generation.

  • Prices, currency, taxes, and the number of credits included are shown before you confirm a purchase.
  • RevenueCat manages checkout and purchase records, and Stripe processes payment information. Their terms and privacy policies also apply.
  • Credits are a limited, personal, non-transferable right to use eligible Web Service features. They are not a subscription, bank balance, or stored-value account, have no cash value, and cannot be resold or exchanged for money.
  • Free or promotional credits may have separate conditions and may be changed or withdrawn where permitted by law.
  • If a payment is reversed, refunded, disputed, or found to be fraudulent, we may remove the corresponding credits or suspend the related account.

5. Refund policy

Except where required by applicable law, purchases of digital credits are non-refundable once the credits have been delivered or used. An AI result not matching a subjective expectation does not by itself qualify for a refund.

If purchased credits were not delivered, a transaction was unauthorized, or a verified technical error prevented the purchased credits from being used, contact support@josephworks.app. We will review the request and provide any remedy required by law. When the Web Service confirms that an eligible generation failed because of a technical error, it may restore the credits charged for that request.

6. Your content

You retain any rights you have in content you submit. You grant us a limited, worldwide license to host, copy, transmit, modify, and process that content only as reasonably necessary to provide, secure, and support the Web Service, comply with law, and enforce these Terms. This license ends when the content is no longer needed for those purposes, subject to backups and legal retention requirements.

You represent that you own or have all rights, permissions, and consents needed to submit the content and authorize its processing, including permission from people depicted or recorded when required. Do not upload confidential information unless you are authorized to have it processed by the Web Service and its providers.

7. AI-generated output

AI output can be inaccurate, incomplete, unexpected, or similar to content generated for other users. We do not guarantee that an output is unique, accurate, fit for a particular purpose, or eligible for intellectual-property protection.

Subject to applicable law and third-party rights, you may use the output generated for you. You are responsible for reviewing the output and ensuring that your use is lawful and does not infringe the rights of another person. Some AI models may have additional license terms or commercial-use restrictions that also apply.

8. Prohibited use

You may not use the Web Service to:

  • Break the law or violate another person’s rights;
  • Create or distribute non-consensual intimate content, sexual content involving minors, or exploitative content;
  • Deceive, defraud, harass, threaten, impersonate, or defame another person;
  • Submit content you do not have permission to use, including copyrighted, private, or confidential material;
  • Create misleading media for fraud, election interference, identity abuse, or unlawful surveillance;
  • Distribute malware, bypass safety systems, probe vulnerabilities, or interfere with the Web Service;
  • Automate or resell access except through a written agreement with us; or
  • Use output as the sole basis for a high-impact decision about another person.

9. Our intellectual property

The Web Service, including its software, design, branding, interfaces, and documentation, is owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you ownership of the Web Service or permission to use our trademarks.

10. Third-party services

The Web Service relies on third parties, including AI model and infrastructure providers, Supabase, RevenueCat, Stripe, and hosting providers. Their services and terms may apply to portions of your use. We are not responsible for third-party services outside our reasonable control.

11. Suspension and termination

You may stop using the Web Service at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, abuse payment systems, threaten the Web Service or other users, or if we are required to do so by law or a service provider.

12. Service changes and availability

We may change, pause, or discontinue models, features, prices, credit costs, or the Web Service. We do not guarantee uninterrupted or error-free operation, permanent availability of generated files, or recovery of an anonymous browser session.

13. Disclaimers

To the maximum extent permitted by law, the Web Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, or loss caused by third-party services, generated output, or inability to access an anonymous session. Our liability is limited only to the extent permitted by applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Applicable law

These Terms are governed by applicable law, without overriding mandatory consumer protections that apply where you live. Any dispute must be brought in a court with lawful jurisdiction unless the parties agree to another resolution process.

16. Changes to these Terms

We may update these Terms as the Web Service changes. We will post the revised Terms on this page and update the date above. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
